By accessing, browsing, or using the services provided by Home Clarity ("we," "us," or "our"), you ("client," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service (the "Terms"). These Terms constitute a legally binding agreement between you and Home Clarity.

If you do not agree to these Terms, you may not access or use our services. Your continued use of our services following any modifications to these Terms constitutes acceptance of those modifications.

2. Service Description

Home Clarity provides real estate consultation services designed to deliver clear, confidence-building guidance to individuals navigating real estate decisions. Our services are informational and advisory in nature and include:

Pricing & Value Guidance: Analysis and insights regarding property pricing, market value assessments, and valuation considerations to help clients understand their real estate asset positioning.

Next-Step Planning: Strategic guidance on recommended actions, timelines, and decision-making processes related to real estate transactions or holdings.

Market Clarity Reviews: Comprehensive reviews of current market conditions, trends, comparative data, and contextual information relevant to your specific real estate situation.

Our services are consultative and educational. Home Clarity does not act as a licensed real estate agent, broker, appraiser, or financial advisor unless expressly stated otherwise. We do not list, sell, or directly transact real estate on behalf of clients. Any actions taken based on our guidance remain solely the responsibility of the client.

3. User Obligations

By using Home Clarity services, you agree to:

Provide accurate, current, and complete information during all consultations and communications. Any decisions or recommendations we provide are based on the information you supply.

Use our services solely for lawful purposes and in compliance with all applicable local, state, and federal laws and regulations.

Refrain from reproducing, distributing, modifying, or creating derivative works from any proprietary materials, reports, or analyses provided by Home Clarity without express written permission.

Maintain the confidentiality of any login credentials, account information, or access codes provided for scheduling or communication platforms.

Communicate respectfully and professionally with Home Clarity representatives and staff.

Understand that our guidance is advisory and that you are responsible for conducting your own due diligence and consulting with appropriate licensed professionals before making real estate or financial decisions.

4. Appointment Scheduling and Cancellations

Scheduling: Appointments for consultations and services may be scheduled through our designated booking system or by contacting us directly at Natalie.Fielder@homeclarity.info. Appointment availability is subject to schedule capacity.

Cancellations by Client: Clients may cancel or reschedule appointments by providing at least 24 hours advance notice. Cancellations made with less than 24 hours notice may result in forfeiture of any prepaid fees or the assessment of a cancellation fee as communicated at the time of booking.

No-Show Policy: Failure to attend a scheduled appointment without prior notice constitutes a no-show and may result in forfeiture of the full appointment fee.

Cancellations by Home Clarity: We reserve the right to cancel or reschedule appointments due to unforeseen circumstances, including but not limited to illness, emergencies, or scheduling conflicts. In such cases, clients will be notified as promptly as possible and offered alternative appointment times or a full refund of any prepaid fees.

5. Payment Terms

Service Fees: Fees for Home Clarity services will be communicated clearly prior to booking and may vary based on the type, scope, and duration of the consultation or service requested.

Payment Methods: Payment may be required in advance of scheduled appointments or upon completion of services as specified during booking. Accepted payment methods will be communicated at the time of scheduling.

Non-Payment: Failure to remit payment as agreed may result in suspension of services, cancellation of scheduled appointments, and potential collection activities.

Refunds: Refund eligibility will be determined on a case-by-case basis. Requests for refunds must be submitted in writing to Natalie.Fielder@homeclarity.info within seven days of the service date. Refunds may be issued at our sole discretion based on the nature of the service provided and circumstances surrounding the request.

Disputes: Any billing disputes must be raised within 30 days of the date of service by contacting us at Natalie.Fielder@homeclarity.info.

6. Limitation of Liability

To the fullest extent permitted by law, Home Clarity and its owners, employees, contractors, and representatives shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to:

Real estate decisions, transactions, or financial outcomes resulting from reliance on our consultations or advice.

Our total aggregate liability for any claims arising from or related to our services shall not exceed the total amount paid by you to Home Clarity for services in the six months preceding the claim.

7. Warranty Disclaimers

Home Clarity services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Home Clarity makes no guarantees regarding future market performance, property values, sale prices, or transaction outcomes.

Clients acknowledge that real estate decisions involve inherent risks and that Home Clarity's guidance should be considered alongside advice from licensed real estate agents, attorneys, financial advisors, appraisers, and other qualified professionals as appropriate.

8. Indemnification

You agree to indemnify, defend, and hold harmless Home Clarity and its officers, directors, employees, contractors, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:

Your violation of these Terms.

Your violation of any third-party rights, including intellectual property rights or privacy rights.

Any misrepresentation of facts or information provided to Home Clarity.

9. Intellectual Property

10. Confidentiality

Home Clarity respects your privacy and will maintain the confidentiality of information shared during consultations in accordance with our Privacy Policy. We will not disclose your personal information to third parties except as necessary to provide services, as required by law, or with your express consent.

You acknowledge that general market insights, anonymized data, and non-identifying case examples may be used by Home Clarity for educational, marketing, or analytical purposes.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Home Clarity operates, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or our services shall be brought exclusively in the courts of competent jurisdiction in that location, and you consent to the personal jurisdiction of such courts.

If negotiation does not resolve the dispute within 30 days, the parties may pursue mediation before resorting to litigation. Each party shall bear its own costs associated with dispute resolution unless otherwise awarded by a court or agreed upon by the parties.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other written agreements executed between you and Home Clarity, constitute the entire agreement between you and Home Clarity regarding the use of our services and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral.

15. Waiver

No waiver of any provision of these Terms shall be deemed or shall constitute a waiver of any other provision, nor shall any waiver constitute a continuing waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16. Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. Home Clarity may assign, transfer, or delegate these Terms and our rights and obligations without restriction.

17. Force Majeure

Home Clarity shall not be liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, governmental actions, or technical failures.
